In a Mess

Hi, I am single mom in a lot of debt,--credit card debt due to wrong decisions, and simply just trusting people. I have decided to join this forum to hopefully get advice and support to help guide me thorugh this dilema.

My scores are mid 500 to low 600. I have already contacted the Credit Bureaus regarding some errors on the report. The hard stuff has appeared to be the old debts that seem to be reaging. I want to avoid bankruptcy, and I want to get rid of the collectors that call me a certain time of year to try and get money out of me. I hope that his forum can help guide me through it and get me back on track.

Welcome. Post your questions in the credit forum and we'll help you.

Some of these debts may be out of statute, when you post we'll ask questions and check.

Until then, don't answer the phone if it appears to be a collector!

I have more knowledge about credit and credit repair, just from being here a short time, than I have had in my entire life. (and I don't even know the basics yet)

Hello all. I read in someone elses post the possibility that creditors/collectors read these forums, so I'm afraid as to how much personal information I should divulge.

I am currently in debt, it is not any huge amount and all my CC's are paid up to date thusfar, however, one (good ole Chase) keeps going over the credit limit due to changes in the maximum credit limit (ie. being lowered) which if I become just a day late with the payment, I get hammered with a $39 returned payment fee (because the idiots didnt change the bank information as requested through their website), a $39 late fee and because of those fees, an over the limit fee of, yep you guessed it, $39. This happened just recently and it sparked the, "I'm tired of this sh*t" attitude.

I tried to get a secured loan with USAA today using my car as collateral (obviously have title to it) which has a low NADA retail value of just $200 less than what I was applying for to pay off the 3 credit cards (which have an average APR of 26%), but, got declined. I really thought I would get approved using collateral. Their reasoning was that there were "credit cards that show you are over the credit limit" which isn't the case and also deliquincies within this year, which IS the case, buuuut, the reason I am applying for the debt consolidation loan (auto loan more less, as suggested by USAA due to its lower interest and because I offered to use the car as collateral).

So, there you go. If a mod thinks I disclosed too much, please do delete as you see fit. I plan to make a more lengthy/detailed post in the credit forum, but, I also wanted to have some type of context in my introduction.

I'm already learning a great deal just from the day of lurking/reading here.. but, from what I can tell, either this site is more dedicated to those that have had their debts go to collection... OR it's recommended to let debts go to collections in hopes that the collectors will screw up. Either way, my main goal is to get the hell out of debt, so, whatever works, especially since my credit is obviously so screwed up to where I can't even seem to take the "responsible" step (ie. the USAA loan I applied for).

Anyway.. heyas all.

I would say that would be a bad strategy, unless you were insolvent and ready to file bankruptcy. Then there is no sense in paying money that could go to necessities for your family. If you can make payments and get out of debt, that will always be the better solution.

I think a lot of people here have some old debts, and when they are close to the statute of limitations sometimes it's better to not pay them. Otherwise, we don't advise that.

Question New member looking for violations...willful noncompliance

I'm new at this so I will appreciate all the help I can get. Corrective criticism is okay...anyway I'm very interested in any recent lawsuits against the credit burea or major creditors that are in violation of the FCRA and also being sued for willful noncomliance. If anybody knows of any recent cases, I would appreciate that knowledge.

Check out case law section and you can post any questions you have in the credit forum. Recent cases are good, but the ones that have set precedent are also important.

Hey welcome aboard - If you are contemplating suits and such, and your screenname happens to be your real name, you might want to PM someone at the Administrator level to change it for you.

Also, if you are looking for case law, please mention your state/circuit - thats a must have piece of info.
