| dynamic strategies, inc. summons I live in Oregon and my boyfriend was served a summons, not for him, but for me, and I am wondering what I am supposed to do as far as the "answer" within 30 days? In addition on the final page after the attorney signature is the "IMPORTANT WRITTEN NOTICE TO CONSUMER(S) which is info on disputing the validity of debt within 30 days. So do I need to do that too? I'm so confused! Mind you I had not, until this summons, received any notice from this Dynamic Strategies regarding the purchase of a BOA cc and demand for payment. Help me please.  |

| Are you sure it is a court summons? The first page usually starts out something like "You have been sued." Was it addressed to you or him? The "IMPORTANT NOTICE" makes it look to me like it may be just a standard dunning letter, the first communication. Check your local rules of civil procedure for time allowed to respond. That is normally included on the first page of the summons. I think we may need more information about what you received. |

| Check with the court house and make sure it is a summons from the court.

| Thank you for your replies. The "summons" is addressed to me only and includes the "summons" page and 4 pages of "complaint" where it listed as "amended complaint-breach of contract" on the right hand side. There is no docket # above it, but there is a docket # hand written on the right side of the summons page with the word "summon" typed below it. I really don't know what to do. The last page of also is dated August 13, 2007, but I just got it less than a week ago. If this is a legitimate suit shouldn't it be printed in the public notices of my local newspaper as well? Any additional suggestions welcome! Thanks again. |

Thanks again. | That depends on your state's rules, however, lawsuits you have seen in the public notices section of your paper are generally what's called Citations by Publication. That means that the plaintiff was unable to serve the defendant by "normal" means, and was given permission to summon the defendant via newsprint.
A handwritten docket number isn't too concerning (at least to me). The papers could have been prepared ahead of time, and once they were filed, the case number (docket number) was given to the plaintiff at the time of filing and payment of fee, and thus were written on the document.
As Hedwig said, Step One is to verify with the court that its a legitimate summons (probably is), and then its time to start getting educated by fire.
What do you know about the debt?
The summons says you have 30 days to answer? That should be from receipt - not filing date.

| So pardon me, this may sound like a stupid question, but I really am uneducated when it comes to all this stuff!  I contact the courthouse by phone I take it, but what exactly do I say? Ugh, I hate feeling so dumb~! And if it is legitimate, do I file a motion to appear and also ask for the validity of said debt? |

| I would go in person with the paperwork you have, and ask them if it is a real case that has been filed. They will not give legal advice, but should be able to advise when your answer is due, and what forms you may need to file. |
