Charge off - Closed/Settled Reporting Lates

Can someone tell me how to dispute this with experian and equifax

Chase-Pier (pier 1 imports)
Status: Closed/Paid in settlement. $63 written off
Date Opened: 4/01
Reported Since: 5/01
Date of Status: 2/02
Last Reported: 11/03

Type: Revolving
Monthly Payment: $0
Credit Limit/Original Amount: $112
High Balance: $315
Recent Balance: NA
Recent Payment: NA

Creditors Statement: Account Closed at credit grantor's request.

History: Charge Off as of Sept 03
Late payments 180 days as of 1/03

Any help would be appreciated.

After 1/03 when it was reporting 180 days late, was it ever caught up? If not, it should have been charged off long before 9/03. I would dispute it as illegally reaged.

The reference to $63 written off. Is that how much you didn't pay in the settlement? Regardless I would argue that it was paid, and therefore not written off.

Make sure that EQ is reporting a Date of Last Activity, and that it is accurate. On EX you are looking for the Scheduled Removal Date. Sometimes they report it, sometimes they don't.

There may be other things you can argue, but you didn't post them.

Thanks for a quick reply! Sorry I didn't give you enough information. This account just looks so fishy.

The entire account was paid off in a settlement with the creditor. A lower amount was agreed upon as payoff. Not sure when or how much (my boyfriends account, he doesnt have the receipt)

EQUIFAX------------------------------------------------
On one Equifax report, $63 was the monthly scheduled payment amount.
Date of last payment: 8/03
(guessing this was date settlement was paid???)
Date of last activity: 9/01

On another Equifax report this is the only information given:
Date opened 4/01
Date reported 11/03
Balance $0
Past Due $0
Credit Limit $0
Status: charge off

EXPERIAN---------------------------------------------
On Experian, the charge off history look like this:
Charge off as of Sep 2003
180 days as of Jan/03, Dec/02, Nov/02, Oct/02, Sep/02, Aug/02, Jul/02, May/02, Apr/02
150 days as of Jun/02
120 days as of Mar/02
90 days as of Feb/02
60 days as of Jan/02
30 days as of Dec/01

i dont understand the legal timeframes yet but
There is a discrepancy of over a year.
should be 180 days in May/02
was charged off in Sept/03
last reporting date in Nov/03----------------------------

no scheduled removal date

we DID dispute this as paid
'account was paid and closed'
came back verified

Doesn't look so much like the discrepancy (for reporting purposes) is over a year, but more so a few months. Regardless, it should be coming off this year. When did you last dispute?

I would dispute with EX that it has been reaged, the Date of Status is incorrect, and that they need to report a Scheduled Removal Date.

FYI - The Date of Status is almost always some amazingly bogus date from who knows where. But, there was some information a while back, that absent a removal date or Date of Last Activity, this is the date FICO uses when calculating a score - thus the argument that the date they are reporting for your BF's tradeline is inaccurate.
