| The trial court found the attorney's repeated attempts to "'dig up as much dirt'" as possible on the defendant constituted a "'blatant attempt to extract a settlement,'" that "'grossly crossed the line'" of proper litigation conduct (e.g.Bakker v. | Defense counsel will use every means necessary to mitigate damages. I once saw local counsel here for Trans Union produce credit reports to the clerk in discovery. And yes, it was viewable on Pacer.
They tried to contend it was an error. Do you know how damn long that would have taken to scan and load via ECF submission . . . error my ass.
Point is that it can get dirty if you can show damages.
