I guess what I am saying is if you sued over a non pp issue. The company knew it was no PP and admitted it but then pulled ALL THREE CR's (soft) is their any liability there? And if so is it 1K?

I would think so but, I would plead another cause of action without that piddly little cap. Negligence, negligent infliction, something . . .
I just don't like pinning myself in at a couple grand. Tends to limit bargaining.
