According to what I found:

Quote:
Unless your suit is based upon property damage sustained in an automobile accident, it cannot exceed $2,000.00. The claim may, however, be subject to statutory damages in excess of $2,000.00 (i.e. Consumer Protection cases or certain landlord/tenant cases). In those cases, the base amount may not exceed $2,000.00 even though the potential award may exceed that amount. You should be sure to include in this section that you are seeking double or treble damages and costs pursuant to the specific statute.

Yes I saw this and also had read the link.
Could not find time limit.
The scoop is I loaned someone money last March (1500) They were to pay me this summer. Well no payment. Now I am being avoided. I did talk to the person several times and each time he said he would pay me some money weekly.
Never got any. He is a waiter here in town, and even when he has waited on me I HAVE TIPPED HIM and he tells me he is sorry but will give me some money soon.
Like I said this has been going on for a long time and I feel he should have tried to pay me something. He was not a friend of mine,(knew him thru one of the people that work for me) just someone that was down on his luck and I felt sorry for him,and he seemed sincere. My husband told me the guy was a sleeze but to do what I wanted but hubby knows I am a soft touch and wicked generous.
So I am going to take him to small claims court and if it is a year, well I only have another several weeks to file suit. If I have more time I will wait and hopefully he will pay me . I don't think so though.
So guess I will call the court house.
As for this, I have NOTHING except I could get a few affidavits from my friend who saw me give him the money and also from another person who heard him tell me he would pay me back, and then a third at the restaurant who heard him tell me that he was sorry that he hadn't paid me but he will before Christmas.
So basically I guess it will be a he says she says?
Anything I can do to get the judge to find for me?
