A judgment creditor can attach your bank account(s), wages, etc.
However, a judgment creditor cannot seize your
federal income tax refund. Your tax refund cannot be taken unless the Treasury Department receives such a request from the IRS, the Department of Education, or a child support collection agency.
State income tax refunds may vary.
Some states allow pre-judgment garnishments.
If your federal income tax refund was seized, was it direct deposited into your bank account? If so, you may be able to have it released. Talk to a licensed attorney in your area.
