Please help - motion for summary judgment?
The attorney for the JDB suing us has filed a motion for summary judgment. We have ten days.
In our answer to summons we gnerally denied their allegations and asked for them to provide proof. Nothing ever happened.
In South Carolina we have alternative dispute resolution in attempt to avoid court, but apparently they are trying to circumvent this.
In motion for summary judgment, they attached another self-serving affidavit ("acct # __ owes x $$$ with last payment made ___") This was notarized by their employee.
They obviously can't provide acceptable proof, so how do we respond to this?
