Possible Dispute - Incorrect Payment Status

Just when I thought I was done...

The last remaining negative mark on my credit report has a payment status with all 3 reporting agencies as either "Debt included in personal receivership" and/or "Debt included in or discharged through bankruptcy Chapter 13."

The issue I have with this, I paid the debt in full 7/2002 (yes it was a collection) but I have NEVER filed for bankruptcy!!! This had not been an issue until this last weekend when my wife and I applied for a new car lease and they brought it up as a huge red flag, resulting in a higher interest rate.

It seems the mark is scheduled to come off 2/2009 but after this weekend I can already see its causing some issues.

Suggestions? I am considering calling the company tomorrow and asking if they would in good faith remove the trade lines since I have paid in full years ago, but I'm pretty sure the request will be denied. The reporting company is MAF collection out of Tampa.

What was the date of first delinquency that lead to the collection? That is the date you use to calculate the 7 year reporting period. If that date is past or closer than the 2/2009, I would dispute as obsolete with the CRA's and include the incorrect BK info. Then go after the collector directly if necessary.

I did some digging and the DOLA is 3/2002. I paid the originating creditor (since they CRA would not accept payment) in 2004 and faxed the collection company a copy of the speedpay confirmation so that they would update the record and remove it from my report. It looks like I never heard back from the CRA, all they did was confirm with the OC that the account was indeed satisfied.

Did you dispute this through the credit reporting agencies? If not, do so. If verified, sue them.

I have an open dispute now with all 3 agencies (started 6/19/08) and I believe I have even disputed this company in the past. I will dig through my records to check how many times I have tried. In the meantime, any suggestions on how to approach the agency to ask them to remove the trade line?

Looks like they removed the tradeline after receiving my CMRRR. They sent back a brief letter asking for me to call their 800 # within 15 days to help in solving this matter. After talking to one of their supervisors, she let me know that they did not have the record in their system nor did they have access to it and would immediately remove the trade line from my report. I received a copy of a letter yesterday stating that they agreed to remove trade line. Thank you guys again for the help.
