Hello,

Help is needed with the Collection Agency response to Validation Letter.

I sent a Validation Letter registered mail to one of the collection companies contacting me for an old debt past the SOL. The response letter contains no payment history, no copy of my original agreement with Goodyear. They do list the old account number and an old balance, which I am not sure if it was the original charged off balance. The collection agency is spelling my name incorrectly. My name is mispelled ....rey and the correct spelling is ....ery, which is a common mistake. Basically the Debt Validation Letter is Goodyear, the original Creditor, the old account number, my name (mispelled) and the old account number. What is my next response? I read the threads and I am confused with all the different letters and defenses mentioned. All your help is appreciated.

If the debt is old and past the 7 years then simply send them a cease communication letter and they can no longer conysct you!

Do you have a copy of the cease communication letter? Also, is it 7 years past the charged-off date?

How is "7 years past the charged-off date" significant?

By sending a C&D letter you only leave the CA two options, 1. sue, 2. go away. Even though it is SOL they may be able to sue.

Send them a letter stating the information they sent you is insufficient.
