Got a collection call on my cell, want to know how it went?

This morning I received a call from a CA on my cell Phone, this is a sumarry of the conversation;


CA REP: Good morning, may I speak with "mr Smith"?

ME: This is Mr. Smith how may I help you?


CA REP: I work for XYZ Collection Agency, are you MR Smith?

ME: I already stated I was MR. Smith, now let me ask you some questions;
1- What is your name


CA REP: My name is "laquita" as I was saying...

ME: Now, now I am not done asking questions;
2- What is the full name of the collection Agency


CA REP: I work for XYZ company, now this call is about...

ME: You do realize you are calling me and I am entitled to know whom I am talking to, I would apreciate if you allow me to finish my questions before we begin. I am controlling this conversation.


CA REP:: What do you mean you are controlling this conversation, obviouslly you know why I am calling "laquita gets mad"

ME: Laquita are you familiar with the FDCPA?


CA REP: Yes I am, are you?

ME: I am.


CA REP: Ugh, what am I doing wrong then?

ME: You are calling me in a way that it is costing me money as the number you are calling is my cell phone. I will request that you delete this number from your database and never call it again. Please send me anything you have to say in writting.



CA REP: But this is the first time we tgalk I was not aware of it.

ME: Now you are, have a nice day.

How do they get everyone's cell number? Did you give it to them, or is there now a database of cell numbers? I know they aren't listed places like switchboard.com.

I've been hearing this a lot too lately and cell phones aren't supposed to listed.

I do not keep it from CA's, Usually include it on my letters and mark it CELL PHONE.

OK, so they should know it's a cell and have reason to believe that you incur costs, therefore they shouldn't call.

roybean, I've been seeing it a lot as well. That's what's making me wonder what's going on.

I'd be willing to bet that someone has access to some databases or something. I haven't had any problems with the current phone that I have, but I suspected at one time and with a prior service that sumptin was up. I wish someone would call me on my cell phone about a blippin debt.

The only problem I've had is some music store that gives lessons obviously wrote down a number wrong and came up with mine. They periodically leave me messages that so-and-so's music lesson is canceled. I actually feel sorry for the people that go there and the lesson's been canceled. I called several times, I think they finally got it corrected because I haven't had a call in several months.

Of course, it's possible that the teacher has actually been showing up!

You know, there is not thing worst than when a CA gets the wrong number and assumes is the right number for whomever they are calling.


In te past I had a CA calling for someone that I did not know. No matter how many times u tell them they do not live there and to take off list, they would still continue to call. How do you deal with them then?

I've been getting strange calls lately too.

I had my home phone number changed, and people keep calling for "Kristy" even though there is no "Kristy" here. I keep telling them they have the wrong number and to take it off their call lists. One CA lady apologized, hung up, and then called back 10 minutes later. I said didnt you just call here and I told you I am NOT Kristy? I screamed and demanded the name of her supervisor, and I heard a dial tone after that....on the caller ID it was an anonymous call !! These collection agencies are calling anonymously!!! I am supposed to have anonymous call block on my phone - (to not let anon calls thru) apparently that is not working either.

Now, I've been getting voice mails from collection agencies looking for "Kristy."

I paid the telephone company for an unlisted number, and I'm also getting telemarketing voice mails for mortgage reductions and other bs. Funny considering I'm a renter.

I'm so sick of these telemarketing and CA companies who like to use the phone as a terrorist device.

What's worse than all this? I owe $480 for a small loan I took out last month. It is past due 48 hours, and they've been calling me 3 TIMES A DAY leaving voice mails about it. 3 TIMES A DAY!! I told them I was at WORK which is why I didnt answer and that they will have their money on Monday.

Nothing like kicking a person when they are down.....

I have had numerous calls lately from an online pharmacy. I asked them to stop calling and as I've said before I'll let people talk to the machine for months, but they fill up my caller ID with 800#'s calling back and forth and over and over and I finally had enough.
I recorded myself telling them to stop calling and some of them aren't 800#'s, so finding them wouldn't be hard. One day I pretended that I wanted to buy something, but that I wanted to pay with a money order, so they connected me to a special line and I got their supervisor.

I told him on tape, this is the last time that I'll ask you to stop calling me. If it happens again I'll bring suit against you.

The young lady called me again, this time she left a message on the answering machine, telling me that she has no other contact information or my adress so she must call me on the cell phone lol.

I am thinking about suing their arse already,

1- Collecting in a way that is costing me the consumere money

2- faliure to provide a notice withing 5 days of first contact advising me of my rights under the FDCPA

Should I give them more time to hang themselves? Two violations is good enough for me, but maybe I should get something in writting.

By the way maybe we should start a forum that deals with the Do not call list, I heard on the radio about a kid with 15 phone elines that makes 100k a year suing telemarketers for violating the act.

Save that message and transfer it to a disk.
You can sue them under the FDCPA 1692d and 1692e in which it states any person and TCPA. There is case law over in the forum.
And I am down for the forum that you suggest.

Try to get the name and address of whoever is calling you looking for someone else. Until you've told them, it can be bona fide error. After that, it's a violation of the law. If you're in a one-party state, just record the call. If you're in a two-party state, make sure you tell them you're recording. Then record the call of you (calmly, don't get upset) telling them that, as you have previously informed them, this is no longer Kristy's number and that they are not to call again. Also ask for the name and address of the company, and when they give it to you send them a letter, certified return receipt requested, informing them that the number they called is no longer valid for Kristy, they have the wrong person, and they are not to call anymore.

As far as your loan, it appears that you went to one of these payday loan places. Don't go to them, they are the biggest ripoffs around, and they also are relentless trying to collect. If it's the original creditor, many of the laws do not apply to them.

The best thing to do is borrow from a family memeber or even take a cash advance against your credit card. Payday loans sound like the rate is low, but it's for a short period. They usually end up costing about 400-500% per year.

Here we go again.....I keep seeing the same number on my caller ID at least twice a day. They never leave any messages. I got fed up and called the number 2 weeks ago, which is HSBC Bank card services. Hmmm a pesky telemarketer?

I spoke to a rep and I asked them why was this number on my ID since I have no business with this bank. He stated it was a call center and they were looking for a Tiffany Harris, who apparently had this phone number before I got it 2 months ago. I said remove this number off your list.....and STOP calling me, there is no Tiffany here and I've told you that at least 2 times already.

Today, guess who calls again? HSBC card services. Heres how it went:

The phone rings and I say Hello. There is silence. I yell HELLO?????

Guy: Tiffany Harris
Me: There is no one here by that name who is this?
Guy: Do you know Tiffany Harris
Me: No I dont. Listen, I have had this number for 2 months and its a private number. I dont appreciate telemarketing calls and I've asked you already to take this number off your list and STOP CALLING!

He hung up!!!

So I called back....and talked to Cody

Me: Why do I keep getting calls when I instructed you to take my number off your list? This is a PRIVATE unlisted phone number and I dont like repeated invasion of my privacy. Who am I speaking with?
Cody: This is Cody. Let me look into that, give me the number
Me: xxx- xxx- xxxx
Cody: Okay I will take it off our list now
Me: Uh.....I spoke to someone in your office 2 weeks ago who said they'd do that
Cody: Well....it is done now
Me: It should have been done the first time I called. Where is your office located?
Cody: town of blah blah...
Me: No, I want your physical offices address!
Cody: I am not at liberty to give that out
Me: Oh, but you are at liberty to keep calling me altho advised to stop?
Cody: Uh.....hold on a second
Me; NO I wont hold, transfer me to your Supervisor NOW
Cody: Uh.....its 1111 Town Center Drive
Me: What suite number and zip code?
Cody: That is the building
Me: No problem, I can find it
Cody: Thanks for calling HSBC card services

Then I hung up.....I think its time to vent and write a nasty letter!!!

Just did a websearch...the address is correct AND looks like they have a history of late posting to customers accounts?

Are you on the Do Not Call Registry? You need to be on it, even if you have an unlisted number. If you are, it's suit time.

If not, get on the list now. You can register here. You have to wait three months before you can file a complaint.

I dont get freaked out if they call my cell phone. It is the only number I have, I dont use a land line..so it only makes sense that a CA would call my cell phone.

Funny. I have said some really f***ed-up things on the phone to them (just becuase I figure it won't hurt anything) but usually I just say "I dont discuss business matters over the phone, please send me any communications in writing and I will communicate with you that way. Thank you (click)"

You know, I remember reading somewhere that you can hook a digital recorder to your cell phone; I need to find or remember where I read it.
Since I am little bit of an electronic geek I am pretty sure it can be done. I'll get back you all on this.

I do not get freaked out, untill it starts costing me money. The dam minutes are not cheap and I am grandfathered into a plan so I cannot change the cell phone number without loosing that plan.

Here is one way.

Cell Phone Recorder

You can also check to see if your phone has a built in record feature or accessory cable made to do this.

My phone does have a built in recorder, but only for something 30 seconds, and I believe there is a cable hook up for my phone.
