1692i vs arbitration

Dunno if anyone ever brought this up before but...

1692i. Legal actions by debt collectors

(a) Venue
Any debt collector who brings any legal action on a debt against any consumer shall—
(1) in the case of an action to enforce an interest in real property securing the consumer’s obligation, bring such action only in a judicial district or similar legal entity in which such real property is located; or
(2) in the case of an action not described in paragraph (1), bring such action only in the judicial district or similar legal entity—
(A) in which such consumer signed the contract sued upon; or
(B) in which such consumer resides at the commencement of the action.
(b) Authorization of actions
Nothing in this subchapter shall be construed to authorize the bringing of legal actions by debt collectors.
Is an arbitration a legal action? If so, compelling arbitration in a far away venue is a violation of 1692i, yes?

Not much caselaw under 1692i, but these are the two most important IMO.

Do you waive the venue provision merely by agreeing to arbitration in a contract (assuming no venue provision)?

Isn't there something in the FDCPA that says a consumer can't waive any of their rights under it?

It is violation of FDCPA, FTC Act, and some state UDAP laws. See if you can locate these cases...

This is an interesting topic of discussion. I have noticed that VL often pulls caselaw pertinent to specific statutes in the FDCPA and FCRA and I vote these types of discussions get their own section on IC. These are important to our cause.
