Any debt collector who brings any legal action on a debt against any consumer shall—
(1) in the case of an action to enforce an interest in real property securing the consumer’s obligation, bring such action only in a judicial district or similar legal entity in which such real property is located; or
(2) in the case of an action not described in paragraph (1), bring such action only in the judicial district or similar legal entity—
(A) in which such consumer signed the contract sued upon; or
(B) in which such consumer resides at the commencement of the action.
(b) Authorization of actions
Nothing in this subchapter shall be construed to authorize the bringing of legal actions by debt collectors.
| Is an arbitration a legal action? If so, compelling arbitration in a far away venue is a violation of 1692i, yes?
Not much caselaw under 1692i, but these are the two most important IMO. Quote:
"Judicial district or similar legal entity," within meaning of venue provision of Fair Debt Collection Practices Act ((FDCPA), means at minimum, that debt collection suit should be filed in state county in which either debtor resides or where contract in dispute was signed. Blakemore v. Pekay, N.D.Ill.1995, 895 F.Supp. 972.
Debtor did not waive violation of Fair Debt Collection Practices Act (FDCPA) venue provision by appearing in proceeding in improper venue and consenting to judgment against him on debt. Blakemore v. Pekay, N.D.Ill.1995, 895 F.Supp. 972.

| This is an interesting topic of discussion. I have noticed that VL often pulls caselaw pertinent to specific statutes in the FDCPA and FCRA and I vote these types of discussions get their own section on IC. These are important to our cause.
