Factoring Accunts

Someone was asking about factoring accounts, and I was cleaning up some of my notes and I came across info that might be of help.

Many moons ago TR helped me with a JDB that was suing me and also had on my CR's (three different TL's)that they were Factoring Accounts .

TR had this to say according to my notes...A JDB is barred by Collateral Estoppel by claiming not to be subject to the FDCPA and using any other name violates 1692-e (14)

JDB's registered as Sales Management or Sales Finace Companies ,cannot be a FACTORING COMPANY.
15 USC 1692e 2 F D C PA 15 USC 1692K Statutory Damages and Punitive Damages Fees and Costs.
MASS Collection Regulations 940 CMR 7:00 M G L C 93A 2 (c)

Assignee does not own debt ,so this is a violation
File a motion to dismiss for failure to show actionable cause.

My case was dismissed with prejudice, and it was in the 5 figures : )

TR really was on the ball with all of this. Anyone know why he is not around anymore? I had heard he went back to *Romania*???
When he was on the boards, where was he living? Wish he would get on line and come visit. : )
