CA/JDB Altering Tactics

I have been told that some CA/JDB are now including language in their letters to try to get a debtor to make a very small payment to show their goodwill in paying off the debt. Or they ae trying to get the debtor to some how admit the debt is, or once was the debtors.

I have also heard but cannot verify that within the last several weeks case law affecting FL debtors and / poss the 11th Circuit concerning my first paragraph has come about. I have not found it yet. If this is true then it is a set back for FL debtors in that FL law states that a partial payment does not reset the SOL clock.

If this is ture then deny, deny, deny........

The recent letter that I got from a JDB said that if I am not able to make the full payment they will accept 18.14 per month until the debt is paid. In fact, they gave me three options. 50% off; 40 % or the 18.00 a month.

Utter desperation on their part in a transparent attempt to comply with the law?

Unless you're in one of those states that has a long long SOL....tell NCO to pound the sand or set them up to violate some more.

You still need to DV. Unless you do so, after 30 days they can assume the debt is yours.

Just be careful on how you word your DV letter.

I lerk all the time. The info here is great and the knowledge of the members is great. There is probably someone here that is or has been in your situation or close to it. Ask away .. "The dumbest question is the one never asked"

Ask away. Everyone here has been in a situation before so don't be shy about asking anything. Everyone has to start somewhere.

Dude, I had twelve CAs and JDBs when I started, so don't feel bad. I also had 35 distinct negative items.
