Need OC Help

Hi everyone!

Thanks for such a great site and I am very happy to have found you.

I'm hoping someone can help me with what I should do next with an OC.

I DV an OC last month because they had re-aged my account by more than a year. On Friday, I received a letter stating that they had reviewed my payment history and have found that they are reporting the information accurately and will not, therefore, change my credit bureau status. This report is being reported as open/charge off.

The OC also sent me the original contract and a copy of the payments I made which mysteriously does not include July 1998 the February 1999. This OC is trying to make it look like I started making payments in March 1999. Unfortunately for them, I have kept all of my bank statements and cancelled checks from 1995 to this point.

I’m not sure why they did not include a complete history of my payments, I suspect they want to keep it on my credit for another year because it is suppose to age off the CRA’s this July. Two of them have already removed the TL.

My question is this. Should I make the OC aware of their mistake and send them proof or should I make them send me proof that I didn’t make a payment until March 1999, when the contract they sent me clearly states that my payments started July 1999?

My last payment on this account was in December 2000. I filed BK 13 in January 2001 and it was dismissed in October 2001 because I sold my home and had no reason to remain in BK.

Not sure if I gave enough information for an answer or even if I explain my situation clearly, if not, please let me know and I will give you whatever information is need.

You can inquire/dispute with an OC about errors, but a validation letter is for collectors and JDBs because an OC is not bound by the FDCPA.

You should dispute with the CRA.

Hi Diva,

Are you looking at individual reports acquired directly from the CRAs? If you are looking at some sort of 3 in 1 report - the information they show may not be accurate.

Secondly, can you post exactly what is being reported and how (Do no post OC name and acct number)?

Finally, when you say your BK was dismissed. Was it dismissed and you started paying your creditors, or did you pay off your creditors with the funds from the sale of the house, and the BK was discharged?

Hi Jlynn,

I am looking at the 3 in 1 report. I don't have a scanner but the OC is reporting it as "Charge-off" "Curreent as of February 2007" " 30 days late" . They are also reporting a balance on all 3 CRAs.

It was dismissed because I could not keep up with the payments because I was so far behind with my creditors. When I sold the house I did not have any funds left to pay the creditors, and the BK was never discharged. However, this creditor did get a small payment from the Trustee in 2001 but they have the last payment being made in 2002.

As JLynn pointed out, online reports are good for monitoring, but you really need the hard copies of your credit reports.
