How Should I Respond to Palisades Collection?

I DV Palisades on March 8 and demanded proof of the debt. Today, I received a letter today stating:

"We have received your correspondence requesting verification of you debt. While we investigate your claim, we have place this account in a dispute status and all collection activity on your account has ceased. Meanwhile, the account infomation that we have on file is as follows:

Previous Creditor: XXXX
Current Creditor: Palisades Collection, LLC
Current Balance: XXXX
Account Number: XXXX
SSN: XXXX
Debtor#: XXXX
Charge off date: (left blank)
Open Date: 3/13/99
Additional Information: (left blank)

Please contact us if this information is incorrect or with any questions or corrections.

This communicatins if froma a debt collector and is an attemp to collect a debt. Any Information obtained with be used for that purpose."


They did not send me validation of this debt and I think they are stalling for time.

What should I do next since they did not validate in the required time?

Also, I received a hard copy of my Transunion report and it does not state that the account is in dispute.

This debt is out of SOL, California-4 yrs, and has been since July 2000.

Hi Diva
I certianly am no pro, but the line that says

"Please contact us if this information is incorrect or with any questions or corrections."

Almost sounds like they expect you to validate it, like you havent already notified them ,why do they think they have sent you correspondence related to this already..

It will be interesting to see what the bigwigs say when they get here.

This is the same as my friends case on the other thread. Credit Diva DVed Palisades under the FDCPA as far as I can tell.

Palisades is trying to make this look like an FCRA dispute. But if it were an FCRA dispute, why would they be mailing this to Credit Diva? The CRAs would be doing that.

We have a new, even slimier tactic.

One last thing....they dont have 30 days to answer a DV. Caselaw has extablished 90 days, but even that is far from established.

If memory serves, Palisades is a jdb. For those of you who remember, isn't this the one that Realtor Ken went after??? Now you need to dispute with the CRAs by certified mail and I cannot stress enough that you need to keep records of all correspondences.

Spinn, thanks for responding. Since there is caselaw establishing 90 days to answer a DV, should I send a second DV letter?

Hi Roybean,

I did dispute with the CRAs and should hear from them by April 18. And, being the oranizational freak that I am, I keep very good records of everything.

Should I just sit tight until I hear from the CRAs or respond to the CA?
