| Arbitration Fairness Act of 2007 Yesterday, Senator Russ Feingold (D-WI) and Representative Hank Johnson (D-GA) introduced the Arbitration Fairness Act of 2007 (attached), which is comprehensive legislation to ban mandatory binding arbitration clauses in employment, consumer, franchise and civil rights disputes. Check out the proposed legislation and let your Congress Critter know how you feel.

| I tried to find out what was going on with this bill and ran across an interesting article by a corporate attorney. Read what he has to say about evidence submitted in arbitration.

Always good to let them know how their constituents feel about pending legislation and remind them the folks at home can and do read, write and retain. LOL. A year ago I had an appointment with a physician for a referral and when I read the binding arbitration clause in the paperwork, I asked the receptionist why I should waive my rights? She, of course was not in a position to discuss the doctor's policy, however, after a few steady questions and evasive receptionist answers I declined to sign the waiver and handed her the clipboard. "But the doctor won't see you unless you sign this." "That's his decision, not mine." The doctor had been lurking and stepped forward. He said he would see me anyway. "Ok" says I and that was that. I did tell him I was not comfortable waiving my rights to a perfect stranger in order to have a simple referral from my doctor. He gave a stock reply. I asked how he might feel if our roles were reversed. He nodded yes, he understood my point and smiled. He did add I was the first patient who read and questioned the provision. Thanks again for the post. |
