| What is hurting me most? Hi all.....I'm new here...what a great place. I have a civil judgement for 2,000 (which I know I can't do much about except wait for it to fall off) 4 charge-offs, 5 late pays and 7 collections on my CR. My question is where to start? What is hurting me the most? Should I focus on disputing the CO's or the collections? They are all small (under $1,000) some ridiculously small, like $68. |

| How long can a judgment be reported in your state?
ie, in FL it is up to 20 years.

| Yes, WA has licensing reqs for CA's. SOLs are: 6 yrs for written contracts; 3 yrs for oral contracts; 6 yrs for promissory notes; 3 yrs for open accounts (credit cards). |

If their license lapsed for one month in 2006, they cannot report.
After doing that determine the SOL for each account. As long as the account is past its SOL then write a letter to the CA that is reporting, sent CMRRR, "I refuse to pay this debt. This letter is in not an acknowledgment t that I owe you, your client or the original creditor any sum of money whatsoever."
Wait until the CMRRR is returned because notification is complete upon receipt. Then dispute the account with the CB's. If it comes back verified then it is a violation.
Then you would write to the CA that verified the reporting that they are communicating in violation of the FDCPA since you told them on xx/xx/xx to cease communication. Remove or be sued.
Your state may not have what is called a Statute of Repose, but this acts like one. A colleague of mine has used this several times very successfully to have negative items removed from a CR.
You want to wait until the debt is past SOL so the CA cannot sue. It may work for debts not past the SOL but the CA may be able to sue you though.

Do not quote me on this, I recall reading in other forums about consumers that disputed all their old addresses. After doing so, they went ahead and disputed the judgments and the judgments fell off their reports. Do not know how much truth there is to that, or even the legality of the practice. Passing on what I read before. |

More than once. IF they decide to respond, their response is something like "yes we really did inquire and yes they really did confirm." How does one proceed from there, short of filing in court? |

| Thanks you guys for the great info. Most all of the bads will not be out of sol until like spring of next year so I guess I will wait to dispute until then. As for the judgement....great ideas. Will do some research and see if this might work. Kinda scary though...I don't want to open a can of worms......they actually did garnish me and took like 1/2 of two of my paychecks just before I left my last job. (Not the reason I left, but a nice benefit that they don't know where I am now.) |
