Question Need some advice on OC not reporting accurately

Hey All,

Well, I'm getting ready to have a little break from school, and after working last year and the earlier part of this year on the things that were more simple, it's now time to attack some of the tougher ones.

Here's the situation, when I lost my job a couple of years ago, I got behind a few times on my home equity loan. When I look at all 3 of the CRAs, they have several instances when the account is reporting as being 30 days last for one month, and then the next month it jumps to being 90 days late. I disputed this with the CRAs and it came back verifieid, and I also disputed this information with the data furnisher, and they also said that it was correct.

Anyone with any common sense knows that it is mathmatically impossible for the above to occur. So here is my question....

I am going to dispute it again with all 3 CRA's stating that "it is mathmatically impossible to go from 30 days late to 90 days late in a one month period." I am also going to dispute this information with the data furnisher.

How legal should I get with both the CRAs and the data furnisher? I know that with the CRAs I would be using FCRA to go after them, and with the data furnisher, I would use FACTA, but should I quote any specifics? Just FYI there are probably about a years worth of lates in some way shape or form, within the last 2 years.

I didn't go legal on either letter on the first ones that I sent out. However, I want to take the appropriate steps to put a fire under the butts.

Do I send the one to the data furnisher first, and then wait to get my green card back before I proceed with the CRA letters?

Any feedback you can provide would be helpful.

I'd dispute with CRA's first and then if you don't get it resolved, do the FACTA dispute. You can "go legal" but make it direct and to the point.

Well, that's what I'll do. Since they are reporting inaccurately to all of the CRAs, I'll get those out this week and see what happens. Wish me luck!

I know....I know....my credit didn't get this bad overnight, and I know it'll take a while to get it back on track. You sure I can't rush this along though?

It is good to dispute with the CRA a few times because you'll have a sufficient paper trail if you need to go after someone directly. I would make the data furnisher the last person I write...after you write to the CRA that you are requesting the method that they used to verify the information including the name and telephone of any furnisher of information contacted in connection with said trade line.

now that I am starting a real paper trail and not online, have they verify the information I then do a reinvestigation and when thats complete I do the facta thing with the each TL.

UPDATE:

Today I received a response back from TU, and it says information, updated. However, I compared my CR from prior to when I disputed the incorrect dates, and now, and I don't see a single difference.

I specifically put into the letter "IT IS MATHMATICALLY IMPOSSIBLE FOR..." and they still ignored it.

Should I wait until all disputes have come back from the CRAs before I send a letter to the OC or should I go ahead and send it out? Or should I do what RoyBean said, and dispute it again and ask for procedural request?

I would probably wait until first results are back from all the CRAs. If they fix one or two, and not the 3rd - its more ammo. Foleys pulled this on me back in the dark ages. Via CRA investigations they updated 3 different reports differently. Just more evidence of not executing a proper investigation, otherwise, all 3 CRAs would be reporting the exact same thing.

Once I pointed that out directly to Foleys in what was more or less a nutcase type letter (this was Pre FACTA days) - I had a positive tradeline in the end.

Then when you redispute with procedures with any or all CRAs send your OC disputes at the same time.

At least that's what I would do...
