Equifax Fails to Correct - Help Needed

Maybe someone can offer some assistance.

I tried the method mentioned with regards to contacting Equifax. I contacted them via cmrrr and informed them that a piece of information (tax lien) in my report did not belong to me. They responded with 'verified' and to contact the court that inserted it. I contacted the court they claimed inserted the information. The court responded; on the court's letterhead, that they did not have ANYTHING in their files on me. I sent a copy of the document to EQ demanding they delete the erroneous information. They responded again with 'verified', contact the court and continued to report. I then asked them to provide proof they verified by providing me with the phone number, address, contact person, email address, etc of the person at the court that verified my information. Again they just responded with 'verified' and to contact the court. They failed to provide ANY of the information I requested.

I then contacted the FTC and filed a complaint. I also contacted the BBB of Atlanta. This has been over the course of several months and even after they were contacted by these agencies, they still respond with their canned response, "verified" contact the source/court. Can anyone offer advice?

Seems to me you need to file a complaint. I don't see where you can do anything else. You disputed the trade line by certified mail, they verified, you contacted the court and have it in writing that the court denies this information (which is good, make copies of the letter from court and put in vault), you even sent the information to EQ.

The only other thing I would suggest if you are near the court in question is to go to the court and see for yourself, just to be absolutely sure there is no information on file about you and then I'd file suit.

Did they note the trade line in dispute at least?


BTW...this is a helluva lawsuit epecially if you HAVE NO tax lien!!!

Someone else may want to chime in here, but I don't see what else the OP can do? S/he has done everything possible. Sometimes all you can do is hit folks over the head with a frying pan before they see reason!!!

Roybean,

I personally went to the court. They have NOTHING on me. I also spoke to the supervisor. He said as long as he's been there, over 10 years, any CRA has yet to contact them to verify someones info.

I beleive I have a case but don't know how to go about starting it or knowing how much I can sue for. Can you offer some assistance?

EQ is the only CRA reporting this? And please say that you have the hard copies of your credit file?

We have examples of complaints here on the board, and you have five yrs. to file for FCRA violations, so you've got time (unless your're wanting finance a home or something and it is lowering your scores, but the longer they report the more damages you have) to start drawing up a complaint.

You can ask whatever questions you have and post the draft of your complaint and we pick thru it for errors and what have you and btw this is a 1681s-2(b), reckless desregard, and maybe some state law violations too depending on where you are.

Look in essentials to see what some actual complaints look like and we'll go from there.

As you know we can't give legal advice but we can damn sure show you where to look and read for information.

I'm from NY and EQ is the ONLY one reporting. I still have hard copies of all; credit files, letter on court's letterhead, letters sent to EQ, my letter sent to FTC explaining problem and their response as well as letter sent from EQ stating they were contacted by FTC, etc.

Also, I'm purchasing a home and this has lowered my score. I'm still wondering how much I can sue the bas@#$*^ for? This has been going on for over a year.

Then you have a cause of action and you have damages (higher interest rates and lower scores) because lower scores will cause your mortgage to be higher,

My guess is that an email to Kent gets this resolved within 24-36 hours, especially with today being a Monday.

But then again that presumes the goal is expeditious resolution as opposed to protracted litigation at the federal level...

You really ought to do some due dilligence before even contemplating formal complaints against a company...Kent would be Kent Mast, General Counsel for the entity whom you desire to take to court. He also occupies an office that has a tendency to be responsive to well-written emails that stick to facts.

Thanks. Do you know how I can contact him via email? I was able to find out some info but not his email address. My facts are well organized. I've saved all correspondence between myself , the Court House, The FTC and EQ. They are chronologically organized.
