The drums of war sound once more

Tomorrow is Xan & Chickie v. TransUnion LLC part quattro.

I've been waiting for this trial for a while. I've not only got a signed "please don't hurt us!" agreement from a furnisher of information claiming an account had been closed and removed from Chickie's files....more than a year ago.... that somehow reappeared on her credit report following an inquiry dispute late last year.

Which TransUnion then verified as true and accurate this year.

Which the furnisher of information swears in an affidavit that they never received any sort of dispute from TransUnion and thusly did not verify, so TransUnion didn't even conduct their usual FCRA violation of not properly investigating at even a cursory level.


TransUnion did not request this documentation in discovery phase, and thusly has no idea it exists. TransUnion is going to walk into trial tomorrow and claim they've done nothing wrong. They've further locked Chickie out of her credit report so that she can't provide documentation of certain things. TU has decided that they're drawing their line in the sand with me on this one, are sick of getting sued, and are going to fight me for once to "put me in my place". Oh, how little they know...

I'd clone William Wallace's "FREEEEEEEEE-DOOOOOM", but "CHAAAAAA-CHIIIIING" sounds so much better.

No word on damages yet. Since TransUnion ignored my discovery request I stated I didn't have the means to state what the total damages were as they made it impossible for me to get a grasp on how much disregard they had shown Chickie. They've got 60 days to get everything to me so I can come up with a number.

I was kind of amused though. One of the TU bigwigs themselves showed up for this one, not some lackey. They really wanted this win :P.

Oh, yeah....this one makes it 54-0 on the Xan vs. The Man scoreboard

Just state. I filed it down on this level with the expectation that TU would remove it to Federal (as they almost always do).

But alas, the combination of the district I'm in (which not only always rules against them, but throws down harsh judgments) and me inspired them to keep it down a notch where they felt I wasn't a 100% mortal lock to win.
