NCO excessive inquiries

Just got my updated TU report...look what I found.

Under the regular inquiries section - (where it says the following companies have received your credit report, their inquiries remain on your credit report for 2 years...)

NCO Financial excessive inquiries:
6/8/2007
4/30/2007
1/13/2007
11/2006
2/3/2006

I did not authorize them to do this...arent these inquiries lowering my score? Now what?

NCO is a collection agency, and they do not need your authorization to pull your cr. Have they dunned you?

IMHO, that is excessive but you'd have to prove it is so in a court of law. Off the top of my head and with little sleep, I don't recall any caselaw to this effect but there may be. Does NCO own any paper you owe or are they attempting to collect?

They need a permissible purpose to pull, such as attempting to collect, right?

Yes. There has been some discussion of pulling of reports when a JDB is thinking of buying debts you owe...however, while that may be a legitimate business need for the JDB, I am not sure whether or not it can be done for that purpose (arguably due diligence) especially if the JDB doesn't end up buying the paper.

In general, section 604 of the FCRA gives them a PP, but that can be argued.

I kept receiving calls and bills from NCO for medical accounts from a Hospital that didnt exist. I disputed with the CRA's and then sent certified cease and desist letters to NCO. It looks like every time I dealt with their nonsense, they pulled my report. I did get 3 accounts deleted tho.

I dont have time to pursue this in court, but I am concerned if these inquiries have lowered my score.

You sent C & D's. Did you request them to validate the debt and then dispute with the CRAs?

If the hospital does not exist; I'd start interviewing lawyer's.

Well, a good indicator would be if you got denied credit due to excessive inquiries.
