Brachfeld & Associates

Received a somewhat threatening message from "Brachfeld & Associates in Houston." According to Bud Hibbs, Brachfeld aka Meridian Management is in California. Is this a branch office, or a ploy to decieve? They left a different phone number than what is listed, too.

It's obviously a well conceived pattern of misdirection and end-arounds designed solely for the purpose of deceiving you, the consumer.

Was the message a recording? Could be a dial out only number on your Caller ID. Was it a non 800 number that called? Did they leave an 800 number for call back? Having you call another number is not unusual for any business.

Who cares if Hibbs says its aka someone else? At this point, IMHO, its a non-issue.

This is consumer. The call came from 888-459-0999, same number as on the dumming letter from Meridian Management. The number told to call was (866) area code. The person actually speaking said to call Brachfeld & Associates in Houston, gave same reference number as on the dunning letter. Already sent DV last week. If I had not felt like poo today, I would have called and asked what they were trying to pull by saying they were in Houston. My guess is that they think by saying they are in a nearby city they have a better chance of a response due to the fear factor of suing.

The msg said something like to call by 10 AM or they would proceed to the next step, this was our only chance, bla bla, repeated it a time or 2. I realize the aka is a non-issue, I was just throwing that out for entertainment purposes.

Can I collect now?

Never would have believed it. Got a call this morning from someone at Brachfeld, the same 888 (Meridan) number on caller ID, with Name Unknown. So the lady says she can't hold it any longer, and they are about ready to sue, the account was notated "refusal to pay" which I said NO!!! I don't know anything about this account. Did I want to make a check-by-phone payment. I hung up at that point. Anyway, yes I DVd them early November, of course nothing was sent. I have a pic of the caller ID with the same number as on the letter.

Normally my attempts at collecting for violations are rewarded with $0 but I will try once more with this one. I may actually have a shot, since I have the pic. My idea of a Pay-up letter, very brief:

Received your letter, DV'd on (date) received by you on (date). Requested validation. More than 45 days later I get a call (see pic) wanting to collect, in violation of FDCPA. You can send me $1K and mark the account paid in full at this time. Failure to reply within 30 days confirms these allegations, allowing me to file in my local court.

Now, I am wondering, send this to Meridian, Brachfeld, send Restricted Delivery for Erica herself, or maybe track down her residence and send it there?
