| Texas Rules! Yes we all know that Texas rules in every way, but this is about the TRCP. Been reviewing the rules, and I started thinking, OK, what are the proper ways to serve the Original Complaint? Rule 21 and 21A address everything after that. So is it necessary to have a process server deliver it, or would CMRRR be adequate? |

| And as a hint...you are not a person who would qualify to serve your own original pleading. No person who is a party to or interested in the outcome of a suit shall serve any process.

Centex, that is interesting. A few years ago when I filed a complaint, the clerks asked if I was going to serve it myself or if I wanted to use a particular server. As a point of curiosity now, would DW be considered interested in the outcome? (at home, she would be of course) Getting close to triple digits! |

But then, I may have misunderstood what the clerk said. It was an original complaint against LVNV, and to make sure I covered all bases, it required three citations and three service of process at $50 each(LVNV, Sherman, Resurgent). Didn't matter that they were all going to the same Registered Agent address. I was hoping to save a few $ and send them CMRRR or hand deliver on my next trip to Houston, but since the clerk highly recommended doing it their way, I went along. The settlement covered the cost and then some. It is the initial outflow of $ that stresses me. I was thinking maybe there was something under the table going on that they were pushing the process server on me. |
