Want of prosecution and substituted service issues (1st COA- Houston)
Texas Judiciary Online - HTML Opinion
Case is out of the First CoA in Houston and involved Hudson & Keyse appealing a dismissal of an action they had filed but were unable to get served. They had sought substituted service after the Defendant called the process server (who had left a card after the fifth attempt to serve) and basically said don't bother coming back here.
No credit discussion to speak of other than it was a suit over a defaulted debt, but there is discussion about dismissals for want of prosecution and the matter of substituted service.
