Does one require permission from other side for MTA or can it just be done by asking leave of the Court?

Do you mean motion to amend? If so, it depends on your rules of civil procedure for your court. Most times you can amend once early on especially if you are pro se as it in the interest of justice. Later in the proceedings, you may have to do it by motion. What state? What court?

In MI the moving party is required under MRCP to attempt to obtain concurrence from the non moving side and to certify such in the Motion.

The reason for this is to not waste the courts time if both parties can agree then a Stip to Amend would be filed.
