Got an Advertisement Letter from an Attorney, saying CapOne is suing
Hi there,
It's been a while since I posted and I have just completed school, so I'm back at it. First to help my sister.
She got a letter in the mail on yesterday, from a local attorney's office offering their services. The letter indicates that she is being sued by Capital One in JP Court.
She has not been served, and has not been notified in any way. How would we go about checking to see if this is the case? She would like to get a head start on it, if this is the case. Oh yeah, she's in Texas as well, Dallas County, and the debt is still within SOL.

I know....I know....my credit didn't get this bad overnight, and I know it'll take a while to get it back on track. You sure I can't rush this along though?

I actually searched the civil courts for the county and I didn't find anything under her name. I also tried using the case number that was listed on the letter, as well. Nothing so far.
So it makes me wonder. I would think that it would have to be in the system for an advertising attorney to have access to it.
Any other suggestions would be greatly appreciated. TIA.

[/quote] Civil courts aren't JP Courts. JP Courts are pretty much the same as Small Claims, and are administered by a Justice of the Peace. The cases are likely not on line. You will need to know what Precinct your sister lives in to determine the court.
Dallas County
Judge Cercone in 3-1 has some good info on his site.

For there to have been an unsolicited offer of assistance, there is a case that has been filed. Subscription services are available that give notice of filings of new cases. Same thing happens on a regular basis for traffic tickets.
My guess would be County Court given that we are talking about Dallas County, but it is also not out of the real of reason to believe that it might have been filed in State District Civil.
Let us also not forget that online searches are not always as complete as actually going to the Clerk's Office and reviewing the records there. The Cause Number will likely give a hint as to what level of Court you are dealing with...
