Fraud

Help! I'm a victim of identity theft. The thief only opened one card. But this card has been the bane of my existence since December. I received the fraudulent credit cards on December 7th. I immediately contacted the company. I was advised that they were going to send out a affidavit for me to complete, once that was done everything would be taken care of. I also filed a police report with my local police department. I never received the affidavit, but they were kind enough to send me a bill for $3500. I sent the company and all three credit bureaus a letter and a copy of the police report. The credit bureaus removed the account from my credit history. I though I was in the clear. But, I'm now getting harassing phone calls and collection letters regarding the bill. The collection agency keeps telling me that I have to clear the bill with the card company otherwise they're going to keep pursuing action against me. Does anyone have any suggestions on how I can make this thing stop!

Send them a letter saying "phone calls are inconvenient". This will make it illegal to call you pursuant to the FDCPA. Send it certified mail.

Buy a phone recorder because they will violate the law. Record a few calls and sue them. After you win they will call you again....sue them again.

Have fraud alerts and a PIN number enacted on your credit file. The CRAs should of done this but may not of. It should be the seven year fraud alert.

File complaints with as many agencies as you can after you have the certified mail receipt proving they got it.

I am in the same boat and calmy tell the crack headed collections agent I can name them personally in a Federal Lawsuit. They then scream "stop watching Jerry Springer and pay your bills!!!" (Once, I actually was wathing Jerry Sprnger).

There are several steps you need to take, check the FTC website.

Privacyrights.org has a nice letter to send to collection agencies.

Privacyrights.org has a detailed guide as to what to do, when to do it, and how to do it. It's more detailed than the FTC material and is well worth the time and effort to follow.
