Pro-Bono Civil Attorney?
Hello,
I am being sued by a collector for $2000, plus attorneys fees for a 5 year old debt that originated from SBC Telephone. This is a complete outrage for many reasons. The summons is full of false information and some serious weirdness.
This is last thing I needed right now. I am experiencing the worst financial down-time of my life and will soon lose my house. I need help, but cannot pay for it. Is there pro-bono representation available?
I am potentially on the cusp of stardom in the music biz. This is the only thing I've got to offer. My attitude is help me and I will help you..also give you props in my album sleeve!
I would really appreciate any advice you could give me.
Thank you,
Ryan

If the debt is truly 5 years old, it is out of statute for suit. Read this thread.
Did you file an answer yet?
Who is the collector?
What state are you in?
Can you post the complaint? Redact personal info before you do so, however.

I would be glad to post the complaint. Is there another means to doing this other than having to retype the entire summons?

Re: Pro-Bono Civil Attorney?
Until I can figure out the means to post my summons I'll post the details.
Superior Court of LA - Northwest District.
Limited Civil
Case # 08E07929
I am being sued by SHORT TITLENCO Portfolio Management (NCO Financial). The attorney is Branchfeld & Associates out of Torrance, CA SBN 180683.
NCO was the original creditor that bought the debt from SBC Telephone 4 years ago.
I have done nothing yet, in response to this.
The debt in question is for long distance charges that occurred shortly after the deregulation of the telephone industry. These charges are from a 3rd party carrier which I never authorized. I did not make these phone calls, nor was I or am I willing to pay for them.
The strange thing about this summons is that NCO/Branchfeld is claiming that I defaulted on an agreement I had with them in regard to payback of this debt, which I would have never done. This is an outright lie. I have, from day one disputed these charges with SBC.
Nowhere on the summons do is SBC mentioned, or the original details (long distance telephone charges) discussed. Only that I had validated the debt, signed into a contract to pay back the debt, and ultimately defaulted on that contract.

Re: Pro-Bono Civil Attorney?
Is this for a cell phone or landline? If a cell phone, did you read the link that hannah provided above?

Re: Pro-Bono Civil Attorney?
The federal statute is for both cell and land line charges.

If you can scan it, post it as an image. If not, please type it out as I cannot help you answer it if you don't tell me what it says. If you'd rather do this off the forum, send it to me by email at sosueme2006@yahoo.com.
