Well let me start off with what happened first.I bought a couch.I had the couch delivered and when I received it it had a tear on the back of the couch.the delivery men said I had to take it up with complete suites in the morning. I called complete suites (furniture company)and let them know of the damage.I told them I wanted to exchange it and they said no I asked to return it and they said they cannot return it even though their policy said I could.So I gave them numerous chances to pick up the couch or to try to get a partial refund.Nothing worked so I disputed the charge on my credit card and I won.
6 months later I get a collection notice.I respond within the 30 days and ask for proof and I never received a response from the CA I called them and I let them know of the situation and they said they did not know why they received this as collections then and said they would look into it.Never got a response.I never heard from them since. a few days ago I get served a summons for the couch It has been 5 yrs since the date of sale and I was wondering if the SOL was the case.I live in WA state.If not what would be a proper defense?
