removing bankruptcies

Hello Everyone:
I am new to this forum and filed a chapter 13 in 2001. It was removed by Experian and TransUnion within 7 years. The laws in 2001 allowed removal of 13's within 7 years. Equifax refuses to remove it and says because it was dismissed it has to stay on for 10 years. Does anybody know anything about this and how to get it removed? Did the law for credit reporting change anytime after 2001? I believe I have a right to have this removed!!!

I am fairly certain the even pre-FACTA revisions, the FCRA allowed BK to stay for ten years. Now, if the BK was dismissed by the consumer and not the court, and you send a certified copy of the dismissal to the CRA'S, they are required to note it as such.

Experian | Ask Max | Bankruptcy law changes did not affect credit reporting

The 7 year period for BK 13 is voluntary on the part of the CRA's. Kinda like extortion to get people to pay something back in order to have better credit sooner. Blows the whole "pay for delete is illegal" idea right out of the water.

So the answer is 10 years, but you get a gift if you complete the CH 13. If you dismissed and it came off in 7 years anyway, then you got a bonus prize.
