One down more to go!

I disputed two accounts with all three agencies, and got an old Target account removed but I have a Victoria Secret account come back verified. I am not sure what to do about the account that came back verified. Here is the deal. It came back stating "Purchased by another lender", yet it was included with a bankruptcy I filed in 2004. The credit report does not reflect it was included with bankruptcy. Since I have the money now, I would love to offer pay for deletion with them. I just want it off my report in general. What are your opinions guys? Your advice is appreciated!

My opinion.

1 You don't owe the debt.

2 Paying a debt discharged in BK that was not reaffirmed legally may cause you some problems you don't want. Seek legal advice before proceeding.

3 Reporting = collection activity. There is no debt to collect. Does the account show a balance due on your report?

4 Use the illegal collection activity and a well written dispute letter to have it removed before paying anything.

It's weird because it shows it was purchased by another lender but it also shows the balance as $0. The pay status shows "Payment after charge off/Collection." I didn't pay anything on it for quite a bit before bankruptcy and definitely have not paid on it since.

Was it purchased by another lender prior to you filing bankruptcy? It may actually be reporting accurately since it is showing a $0 balance.

You can always argue that YOU didn't make any payments on the account, but this sounds like TU reporting - that seems to be how they "handle" status' of sold accounts.

While I agree with Pale that paying a BK'd debt might have unintended consequences, I don't agree that the reporting = continued collection activity...

Are they not required to notify me once they sell the debt? I didn't get anything saying it was changing hands when I filed.. My ultimate goal is to get this removed..

I meant to say that it would be collection activity, IMO, if it did show a balance.

I don't think they would have to notify you of the change in ownership. They would have lost any rights they had if they did not show up to the creditors meeting, and it was discharged anyway. If it is reporting correctly, and the balance is $0, about the only thing that would change is a notation that it was included in BK. That would not help you at all. They may or may not go for the pay for delete. Most collectors will not, but they may consider it since there is no other way they will ever see the money.
