here's one for the crew help if you can!! I'm filing a motion to set aside a default judgment as i mention before with crap one bank. I just look at a copy of my tri merge credit report with crap one bank reporting open in 7/97 which is correct and last active 06/08 which is totally false. they say they close the account 9/08 (false) the account was close in 04 high credit limit 1300 high balance 5671pas due bal 4576 take in mind I had 2 accounts with crap one which they state the same thing with the other account but the high limit was 1200 high bal 4188 past due 4142 last active 01/04. same situation with lvnv funding, citibank home depot someone tell me do I have a case against them for any violation

First things first- punctuation is a wonderful thing. They teach it in school for a reason.

As to reporting, never trust a tri-merge report for specific facts on a tradeline. They are not always accurate in the manner in which they compress and distort information from the Big 3. Secondly, Date of Last Activity does not mean a date you necessarily utilized the account. It simply reflects the last date that ANY activity happened with the tradeline. It could be a date that a dispute was responded to or it could be a date that some other activity transpired. As far as a closure date, it again becomes imperative to know what is on a REAL report, not the tri-merge crap.

Another consideration on closure dates is that it is entirely possible that CrapOne finally sold off your account, thereby closing it on their books. They are a rarity in that they rarely sell off their paper.

Until you have REAL reports, no assessments worth a damn may be made on whether there are issues that *might* be actionable. Granted, I am sure there will be other sites that would tell you that such mundane details don't matter, but we tend to like to make sure on this site that people have their ducks in a row before going off half-cocked...

Is there any way to find out what the last activity was?

You can contact he original creditor and ask or look at bank records to see when last payment was made.

I am trying to file a Motion to Vacate a Judgment. I paid it in full recently, but I want it removed from my credit. I wanted to use excusable neglect, since I had a medical hardship with my two toddlers diagnosed disabled and had to quit work immediately. I feel like I have a good defence. I went to our local Clerk of Court and guess what? She said, "I have never heard of a Motion to Vacate a Judgment Form." What the heck? Am I wrong in thinking this is a legal form?
