I'm not sure if they can take income tax return for a credit card - not directly anyway. If the check was direct deposited into the bank account, it is likely fair game.

Now, they can't do any of that without having a judgment against you first (in most states).

Yes, they can sue you and if you don't respond and/or lose they can obtain a judgment. Judgments can stay on your credit report either 7 years, or until your state's SOL for collection of a judgment expires - whichever is longer.

But just because the judgment falls off the credit report doesn't mean that they can't still collect on it and possibly garnish bank accounts and/or wages, depending on your state law. You need to find out what the SOL is for judgments in your state, and find out if they can be renewed.

A judgment creditor can attach your bank account(s), wages, etc.

However, a judgment creditor cannot seize your federal income tax refund. Your tax refund cannot be taken unless the Treasury Department receives such a request from the IRS, the Department of Education, or a child support collection agency.

State income tax refunds may vary.

Some states allow pre-judgment garnishments.

If your federal income tax refund was seized, was it direct deposited into your bank account? If so, you may be able to have it released. Talk to a licensed attorney in your area.
