			<content:encoded><![CDATA[<div>My credit blew up in my face after the economy tanked. I was making good money selling certain products via the internet. Everything was great, I had credit cards and was paying them to $0 monthly.<br />
Then I got sued by two customers. One sued me from another state.<br />
Of course I tried to make amends prior to the suits but that didn't work because they wanted more money from me than they paid.<br />
Then the economy tanked and no one was buying my product anymore because it was an item that was more of a luxury product.<br />
Well anyway, the dominoes fell and now I have two judgements, cannot buy a home, ect ect.<br />
I have a student loan and a car loan which I can pay and am now caught up on making payments. I can't really pay the rest, and tried to settle on the judgements directly with the folks but I can't find one and the other asked me to wait until last Thurs for an answer and is now not answering me at all.<br />
I want to move forward and the one from Iowa can have the judgement appear for 20 years.<br />
Will a bankruptcy hurt me?<br />
Can I buy a home later even with a bankruptcy at some point?<br />
I have 4 dependents and I make about $12.00 an hr. I'm not living large anymore.</div>

Georgia's sol for credit cards used to be 4 years, but in 2008 due to an appeals court - it is now 6 years.  Is there any kind of argument that since a default happened &quot;before&quot; the new law - could it go by the original 4 years sol?<br />

Or is there any case law for Georgia supporting a cardmember agreement that states that Delaware or Virginia's laws will govern the agreement?  I know that in Georgia, they use procedural law which will then go back to Georgia's sol, but that just doesn't seem fair!  The card agreement states in black and white that it will be held by Delaware or Virginia's laws and they sure used that to reap their interest rates, but then get to use my state's sol to sue?  This just means that they reap the high interest and then my own state allows this to continue for a &quot;longer&quot; period of time (6 years) before they have to file suit - all the while piling the debt as high as possible!  :mad:<br />
<br />
Could invoking arbitration possibly force this out of the court system and then have the opportunity to go back to the Delaware or Virginia's sol?  Also wondering if there is any case law for this?<br />

I have yet to meet with anyone and I have to show up for court on Wednesday.  I'm working on answering the complaint that was made, but it's proving to be difficult.  I should state that I am unemployed with VA checks and my husband is getting out of the army this week.  So the only income coming in will be my check.  And, I am 8 1/2 months pregnant.  Yeah, these guys decided on a really good time to hit me with this :(  This is what the complaint said:<br />

Plaintiff, by its attorneys, complains against the Defendant as follows:<br />
<br />
1. Venue is proper as the Defendant resides within this county at ___________ and/or entered into a Contract within this county.<br />
<br />
My story:  I entered in the contract in Alabama but I now live in Colorado.<br />
<br />
2. The amounts the Plaintiff claims from the Defendant are $1058.64 which represents liquidated balance of the Defendant's credit card amount owned by the Plaintiff, plus interest of $104.47 and reasonable attorneys' fees in the amount yet to be determined and awarded by the Court, and Court costs, along with continuing interest at the rate of 19.9% per annum.<br />
<br />
My Story: I had a Capital One card with a limit of 500.  Became unemployed and my last payment was April of 2009.  The card contract was signed in April of 2008.  I never heard anything until January of this year when First Source took over the account and said I owed $1075.  Capital one is the supposed plaintiff that is suing me now and their attorneys' are Machol and Johannes out of Denver, CO.  I don't see how it went that high and the extra charges they mention seem outrageous so I'm not sure how to respond to this one.<br />
<br />
3. The Plaintiff claim arrises from the Defendant's failure to pay the liquidation balance due on credit card number __________ as required by the cardholder agreement.......blah, blah, blah.........Plaintiff's attorneys, barring a change in circumstance or new developments arising in the case, anticipate presenting to the Court a request for an award of reasonable attorneys' fees in the amount of $400.<br />
<br />
4. Defendant is not a minor, in the military, etc.........<br />
<br />
5. Plaintiff does not demand trial by jury<br />

Hope to get some help on answering this!  I was thinking about asking for discovery (don't know how to go about that) and proof I owe that much because it seems outrageous.  Plus it seems strange to me the amount kept changing from 900s to 1000s to 1075 to 1056 from when it was sent to First Source to these attorneys'.....  I wish I had more time to work on this but I've had complications during this entire pregnancy so I'm hoping to get some fast info on what needs to be done.  Thanks ahead of time!</div>

I am trying to repair my credit so that I may purchase a house in the near future.  I am just starting with the repair process so as you can imagine I'm pretty overwhelmed.<br />
<br />
I decided to try to call a CA to attempt to resolve one of the smaller debts ($268 from a $30 original balance on a sears card), but when I was on the phone with them they brought up another debt, a very old one that I didn't realize they were in charge of.  They asked me if I wanted to talk about that one and I said no, but then she played a recording which went way too fast and said something about me sending them a letter within 30 days.<br />
<br />
I ended up setting up a settlement for the sears card, but I'm worried that I may have &quot;refreshed&quot; the other (larger) debt, which was supposed to fall off the reports later this month (I believe)<br />
<br />
In your opinion, should I be worried about the debt reappearing on my report, and if so, can I prevent it?   I was close to paying them to settle it, as they were down to 10 cents on the dollar of the original amount, but if it's about to fall off I'd rather just let it.<br />

In a decision handed down late Tuesday, U.S. District Judge William Alsup accused Wells Fargo of &quot;profiteering&quot; by changing its policies to process checks, debit card transactions and bill payments from the highest dollar amount to the lowest, rather than in the order the transactions took place. That helped drain customer bank accounts faster and drive up overdraft fees, a policy Alsup referred to as &quot;gouging and profiteering.&quot;<br />

Wells Fargo adopted the policies beginning in 2001, and they became widespread across the banking industry. It is unclear how the ruling would apply to the rest of the industry.<br />
<br />
The ruling detailed the experiences of two Wells Fargo customers who used their debit cards for multiple small purchases, and were then charged hundreds in overdraft fees because the order the purchases were cleared by the bank depended on the amounts. The judge found the customers, who were part of a class action, were not properly informed of the bank's policies on processing payments and were unaware the bank would allow debit purchases to go through when their accounts were overdrawn.<br />
<br />
&quot;Internal bank memos and e-mails leave no doubt that, overdraft revenue being a big profit center, the bank's dominant, indeed sole, motive was to maximize the number of overdrafts,&quot; Alsup wrote. That policy would &quot;squeeze as much as possible&quot; from customers with overdrafts, in particular from the 4 percent of customers who paid what he called &quot;a whopping 40 percent of its total overdraft and returned-item revenue.&quot;<br />
<br />
The judge dismissed Wells Fargo's arguments that customers wanted and benefited from the policies, and detailed evidence he said showed efforts to obscure the practices in statements and other materials. Wells Fargo's online banking system, for example, would display pending purchases in chronological order, &quot;leading customers to believe that the processing would take place in that order.&quot;<br />

&quot;The supposed net benefit of high-to-low resequencing is utterly speculative,&quot; he wrote. &quot;Its bone-crushing multiplication of additional overdraft penalties, however, is categorically assured.&quot;<br />
<br />
Alsup also criticized the bank for allowing overdraft purchases after accounts had been drained by offering a &quot;shadow line of credit&quot; that customers were unaware existed.<br />
<br />
The decision noted that the Federal Reserve has outlawed some of the practices detailed in the case, most notably debit card overdrafts permitted without customers agreeing to accept overdraft protection.<br />
<br />
Judge Alsup ordered Wells Fargo to stop posting transactions in high-to-low order by Nov. 30 and to reverse overdraft fees charged to customers from Nov. 15, 2004, to June 30, 2008, as a result of the policy. A study cited in the decision by a Wells Fargo witness put the restitution at &quot;close to $203 million.&quot;<br />

Wells Fargo spokeswoman Richele Messick said the bank is &quot;disappointed&quot; with the ruling. &quot;We don't believe the ruling is in line with the facts of this case and we plan to appeal,&quot; she said.<br />
<br />
Messick noted that Wells Fargo changed its policies earlier this year, and customers can no longer incur more than four overdraft charges in one day.<br />
<br />
Wells Fargo shares closed Wednesday trading down $1.47, or 5.3 percent, at $26.30, as the broader markets dropped sharply on economic concerns, with banks being particularly hard hit.<br />

I am married and me and the wife just came out of chaper 13, the term of the 13 was 5 years, when we went into the the 13 I was making 50k and the wife was making about 150k as time past the salaries increased. I am making 100K and the wife is making a little over 400K. we have 2 mortgages on 1 home both mortgages have been paid on time. We have no credit cards due to reckless spending when we were younger, and we pay for mostly everthing in cash. We are also paying the mortgage for our inlaws off the books for a home they have. As I stated before the credit is horrible but we did notice inacurrate info on my wife's credit report.<br />
This was strange because mostly everthing is in my name, mortgages and car note which we finished paying.<br />
We are now trying to get a new car and cannot get financing although we have good salaries. Our friends cant seem to understand why we are riding in such old automoblies when we are making that kind of money, its none of there buisness but I guess I would be wondering the same thing.<br />
To clean up my wifes credit we have hired a credit repair service and they are sending out the letters, my question is.<br />
<br />
Is there another way to get around the bad reports. We have tried hard financing were they lie and tell you that they can put you into something, i really dont know why they mislead folks like that. But i guess thats the name of the game.<br />
<br />
It is just really frustrating and embarrassing, any ideas out there ? I guess we can save but we dont want to put a wad of cash down we are planning home renovations and will be paying cash for the renovations.</div>

I moved out from a rental agency in Nov 2009. They sent me a  statement of account and I owed them 671.00. I have $471 in damage deposit since 1993. They took that and are charging me $671 for cleaning that did not take place. I learned from my neighbors(I was there for 10 years) that the day after I move out they the carpets, and floors were ripped out  and the windows and the roof to give theplace a new makeover.<br />

I do not owe them any money....They are charging me 20 hours of cleaning at 15.00 per hour and money for disposal fee and whatevernots. I wrote them a letter of dispute but they sent the dept to a collection agency who contact me twice and I made her an offer but she would not hear of it whe wants the complete amount.  I did not hear again from her and today after applying for aline of credt I found that the collection agency put that debt on my file.  So I am messed up credit wise until 6 years from now...<br />
Anything that anyone knows that I can do to correct this sistuation?</div>
