I have been trying to get some help with it from legal aid and other organizations. I have yet to meet with anyone and I have to show up for court on Wednesday. I'm working on answering the complaint that was made, but it's proving to be difficult. I should state that I am unemployed with VA checks and my husband is getting out of the army this week. So the only income coming in will be my check. And, I am 8 1/2 months pregnant. Yeah, these guys decided on a really good time to hit me with this :( This is what the complaint said:

Plaintiff, by its attorneys, complains against the Defendant as follows:

1. Venue is proper as the Defendant resides within this county at ___________ and/or entered into a Contract within this county.

My story: I entered in the contract in Alabama but I now live in Colorado.

2. The amounts the Plaintiff claims from the Defendant are $1058.64 which represents liquidated balance of the Defendant's credit card amount owned by the Plaintiff, plus interest of $104.47 and reasonable attorneys' fees in the amount yet to be determined and awarded by the Court, and Court costs, along with continuing interest at the rate of 19.9% per annum.

My Story: I had a Capital One card with a limit of 500. Became unemployed and my last payment was April of 2009. The card contract was signed in April of 2008. I never heard anything until January of this year when First Source took over the account and said I owed $1075. Capital one is the supposed plaintiff that is suing me now and their attorneys' are Machol and Johannes out of Denver, CO. I don't see how it went that high and the extra charges they mention seem outrageous so I'm not sure how to respond to this one.

3. The Plaintiff claim arrises from the Defendant's failure to pay the liquidation balance due on credit card number __________ as required by the cardholder agreement.......blah, blah, blah.........Plaintiff's attorneys, barring a change in circumstance or new developments arising in the case, anticipate presenting to the Court a request for an award of reasonable attorneys' fees in the amount of $400.

4. Defendant is not a minor, in the military, etc.........

5. Plaintiff does not demand trial by jury



Hope to get some help on answering this! I was thinking about asking for discovery (don't know how to go about that) and proof I owe that much because it seems outrageous. Plus it seems strange to me the amount kept changing from 900s to 1000s to 1075 to 1056 from when it was sent to First Source to these attorneys'..... I wish I had more time to work on this but I've had complications during this entire pregnancy so I'm hoping to get some fast info on what needs to be done.
