Continued Violations Meet The Definition of Willful - New Caselaw
This is not a FDCPA or FCRA case but it establishes (at least in the 4th) that knowingly continuing to violate is willful. In this case it was adjudged that the undisputed evidence, including [Valley Gun’s president’s] own testimony, conclusively establishes that [Valley Gun] was well aware of the regulations imposed on federal firearms dealers and yet, despite that knowledge, continued to violate those same regulations. Thus, [Valley Gun’s] conduct clearly meets the definition of willful.
