For purposes of credit repair and debt collection, you might want to bookmark:

Finance Code - Chapter 392.
Although there appears to be no private right of action, Chapter 391.

Business and Commerce Code - Chapters 17 (a cross reference to 392) and Chapter 20.

Is anyone aware of the Texas AG bringing a Chapter 391 claim against anyone?

Not sure about the AG...I had some discussions with a member of Travis County staff at lunch a few years back and could probably have persuaded them to move forward. It was the only time I regretted not being in WilCo since they probably could be persuaded to pick it up on principle alone.

The people I knew in the AG's office were not in the consumer section but dealt with Medicare Fraud and Computer Crimes. Many of them used the experience and got better paying work with other agencies...the ones that worked Computer Crimes had a high rate of burnout because of the nature of the crimes they were working (chat room stings).

(c) An offense under this section is a misdemeanor punishable by a fine of not more than $200

I expect there isn't enough meat there to get an AG interested.
