Settlement Agreement - No Unilaterall Changes

Settlement agreement -- Where debtor entered into settlement agreement with credit card company whereby debtor agreed to repay debt in return for removal of any negative credit history from credit report, and credit card company unilaterally struck from agreement the provision relating to removal of negative credit history before filing agreement with court, court did not abuse its discretion in vacating the agreement and ordering credit card company to refund money to debtor -- Filing of voluntary dismissal of action by credit card company did not divest court of jurisdiction where court had previously dismissed the action, but reserved jurisdiction to enforce the agreement
