FCRA ? Is it true CRAs do not report arrests without convictions?

I have had a arrest for something I was not convicted of. Well over 10 years ago. Does anyone know if a Consumer report agency reports that? What does it mean to be protected by FCRA?

If you were not convicted it shouldn't show up on a criminal background search, even if they search the county you were arrested in. Typically criminal checks only go back 7 years anyways but it depends upon what the company requests from their vendor. The FCRA must only be followed when a company uses a vendor to obtain a consumer report (most companies do). Before they do the check they have to have your permission in writing. Before an "adverse employment decision" (i.e. not hiring you due to the contents of your consumer report) they have to tell you your rights under the Act.
